By accessing or using CalTrakkr (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. The Service is operated by Jason Javoian (“we,” “us,” or “our”).

2. Use of the Service

You must be at least 16 years old to use the Service. You agree to use the Service only for lawful purposes and in a manner consistent with all applicable laws and regulations. You are responsible for maintaining the confidentiality of your account credentials.

3. Accounts

You are responsible for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts at our discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

4. Subscriptions & Billing

CalTrakkr is offered as a paid subscription at $75/year. Subscriptions are billed annually through our payment processor, Paddle. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time; access continues until the end of the current billing period.

5. Refunds

All sales are final. Because you gain immediate access to the full Service upon purchase, we do not issue refunds for subscription fees once charged.

Cancellations: You may cancel your subscription at any time from your account settings. Cancellation stops future charges; you retain access until the end of your current billing period. No partial refunds are issued for unused time.

6. Health Disclaimer

CalTrakkr is a nutrition and fitness tracking tool and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making changes to your diet or exercise routine.

7. Intellectual Property

All content, design, and code within the Service are the property of Jason Javoian and may not be reproduced or distributed without written permission. You retain ownership of any personal data you submit to the Service.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, Jason Javoian shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

11. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by posting the new Terms on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance.
